Actually did a lot of reading on these Bergbau men..
Some Officers from the Heer did service 6 months at a time in the mines supervising the work.. maybe that's why some had the eagle on their caps?

IMO, a lot of Bergbau men just slapped whatever eagle they could find on their hats, regs be damned:
“Show me the regulation, and I’ll show you the exception.”
